MagMo Account Status (Beta Testing):

MagMo account is in beta stage, which means our account system is still in testing. When you register a MagMo account you acknowledge you are helping MagMo test the account system, and MagMo is not responsible for application errors or service interruptions and will do its best to minimize these occurrences.

By using the MagMo’s services, users agree that all content, whether publicly posted or privately transmitted, is the sole responsibility of the person who has generated, transmitted, shared or posted the content. This means that users, not MagMo or its parent company MagMo, Inc. are entirely responsible for all content at every stage. This includes editing, uploading, posting, sharing, emailing or otherwise transmitting or making available content via any of the services provided. MagMo does not guarantee the storage of content and is not intended as a back-up solution. Users should back-up all content they consider important. MagMo is not responsible for content that is lost or damaged.

By using MagMo products or services, users agree that it is prohibited to edit, upload, post, share, email or otherwise transmit or make available any of the following:

Content that is unlawful, abusive, obscene, pornographic, profane, harmful, threatening, harassing, vulgar, defamatory, libelous, invasive of another’s privacy, or hateful racially or ethnically.

Content that you do not have a right to edit, upload, post, share, email or otherwise transmit or make available according to any law, or due to contractual or fiduciary relationships. This includes inside information or proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements.

Content that could infringe copyright laws or other proprietary or intellectual property rights without the explicit permission of the owner and the persons (or their parents or legal guardians, where applicable) who are shown in the content, if applicable.

Any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.

Unsolicited or unauthorized advertising, promotional materials, “junk mail, ” “spam, ” “chain letters,” “pyramid schemes, ” or any other similar forms of solicitation.

Conduct:

We expect users to use the services provided by MagMo in a lawful and respectful manner. In particular, by using our services users agree to not partake in the following:

Harass, “stalk” or otherwise harm others, or violate any laws that protect minors in any way.

Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity, including forging headers or otherwise manipulating identifiers in order to disguise the origin of content.

Download content posted by another user that you know, or reasonably should know in a manner that is not lawful.

Advertise or offer to sell or buy any goods or services for any business purpose, unless MagMo explicitly allows such messages.

Interfere with or disrupt the Service or servers or networks connected to MagMo, or disobey any requirements, procedures, policies or regulations of networks connected to the Service.

Facilitate the sale or use of narcotics, steroids, prescription drugs and devices, tobacco products, certain controlled substances or other products or practices that present a risk to consumer safety.

Facilitate activities involving the use of ammunition, firearms, knives, or other weapons that are regulated under applicable laws.

Facilitate activities involving gambling, betting on sporting events, horse or dog racing, or any other activity that indirectly supports gambling.

Violate any code of conduct or other guidelines which may be applicable for any particular area of the Service, including any applicable local, state, national or international laws, or other regulations with jurisdiction.

You understand that by using the services of MagMo, you may be exposed to content that is offensive, indecent or objectionable, content that promotes activities or practices that pose a risk to your health or that are otherwise illegal or objectionable. MagMo is not liable in any way for user content, or for loss or damage of any kind, including bodily injury and death that may be incurred as a result of the using our services.

You acknowledge that MagMo does not pre-screen content, but that MagMo and its designees shall have the right (but not the obligation) to refuse, remove or move any content at their discretion, either permanently or temporarily, because that content violates our codes of conduct or regulations. Users agree to evaluate and bear all risks associated with the use of any services provided by MagMo.com and are responsible for any content they have edited, uploaded, posted, shared, emailed or otherwise transmitted or made available via any of the services provided, including the safety and accuracy of such content.

MagMo does not claim ownership of any of the content you edit, upload, post, share, email or otherwise transmit or make available via the services we provide. However, in those instances where you upload, post, share, email or otherwise transmit or make available content, you hereby grant MagMo a nonexclusive, worldwide, royalty free, non-revocable, sub-licensable license to use, copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat such content for the purpose of promoting MagMo, or for other functions that may help to improve the services we provide. Other than when requested or permitted by you, the user, MagMo will not use, copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate or reformat your photos.

MagMo respects the intellectual property of others, and we ask our users to do the same. MagMo will promptly process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act (“DMCA”) and other applicable intellectual property laws with respect to any alleged or actual infringement. If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, please provide our copyright agent with the following information:

An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest.

A description of the copyrighted work or other intellectual property that you claim has been infringed.

A description of where the material in question is located, including details that will assist our staff with locating it on a specific place on the website.

Except as expressly authorized by MagMo, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the service or the software of MagMo, in part or in whole. Software, if any, that is made available to download from the Service, excluding software that may be made available by end-users through the Service, is the copyrighted work of MagMo and/or its suppliers. Your use of the Software is governed by the terms of the end user license agreement, if any, which accompanies or is included with the Software (“License Agreement”). You may not install or use any software that is accompanied by or includes a license agreement unless you first agree to the License Agreement terms. It is also prohibited to sell, assign, sublicense, or otherwise transfer any rights to the Software. You agree to not modify the Software in any manner or to use modified versions of the Software, including for the purpose of obtaining unauthorized access to the Service. You agree not to access the Service by any means other than through the interface that is provided by MagMo for use in accessing the Service. Any rights not expressly granted herein are reserved.
